The agreement between you and Hofmann Handelsgesellschaft mbH for the use of fastpal.

1. Who you are contracting with
fastpal is operated by Hofmann Handelsgesellschaft mbH, Regerstr. 1, 48301 Nottuln, Germany, registered at Amtsgericht Coesfeld under HRB 18001 ("we", "us"). Full details are in the imprint.
These terms apply to your use of fastpal.com and everything we provide through it. They do not cover the separate contracts you hold with Hetzner and Anthropic, which are described in section 5.
2. What fastpal does
fastpal sets up and manages a server that runs Claude Code, the coding agent made by Anthropic, and lets you work with it in your browser. It also connects that server to your own computers so the same files and the same agent state are available in both places.
The essential point, and the one that shapes most of what follows: the server is yours, not ours. fastpal creates it inside your own Hetzner account using an API token you provide. Hetzner bills you for it directly. We do not own it, we do not host it, and we cannot delete it once your contract with us ends.
We provide the web application, the relay that carries the connection between your browser and your server, and the software that runs on the server.
3. The agent acts on its own
Claude Code is an autonomous agent. On your server it runs without asking for confirmation before each step. That is the point of the product, and it is also its main risk: the agent can create, change and delete files, install software, run commands, and contact services over the network, including services that cost you money.
You are responsible for what the agent does on your server, in the same way you would be responsible for commands you typed yourself. Keep backups of anything you cannot afford to lose. File synchronisation to your own computers is not a backup: a deletion synchronises just as reliably as a change.
The agent works from instructions, and instructions can come from files it reads. If you let it read material from other people, treat that material as capable of steering it.
4. Accounts, organisations and seats
You need an account to use fastpal. Keep your credentials to yourself, and tell us if you believe someone else has access to your account.
An account can create an organisation and invite colleagues. Whoever owns the organisation pays for it: the subscription covers one seat per member, and the number of seats follows the number of members automatically. Adding a colleague increases the amount due, removing one reduces it, each prorated by Stripe for the remainder of the current month.
Members of an organisation work with the service credentials of the person who set it up, including that person's Anthropic API key. Anyone with terminal access to a server can read the keys placed on it. Do not invite people you would not trust with those keys.
The person who set up the organisation can remove a member. Doing so destroys that member's server and everything on it that was not synchronised elsewhere. The login account itself remains.
5. Services you contract for yourself
fastpal needs two accounts that are yours, not ours:
- Hetzner Cloud, where your server runs. Hetzner's terms apply between you and Hetzner, and Hetzner invoices you for the server. If you stop paying Hetzner, your server stops, and there is nothing we can do about that.
- Anthropic, for access to Claude. You either supply an API key, in which case Anthropic bills you for usage, or you sign in to your own Claude subscription on the server. Anthropic's usage policies apply to everything the agent does.
What you pay us is the 10 € per person per month described below. It does not include what Hetzner and Anthropic charge you, and those amounts depend on how much you use them.
6. Price, billing and the free trial
fastpal costs 10 € per person per month, or 10 $ per person per month if the billing address you give us is in the United States. Prices in euro include German VAT where it applies; prices in US dollars are exclusive of any sales tax, which is added at checkout.
New accounts get 14 days free. The trial needs no payment details and starts when the account or the organisation is created. When it ends, terminals and new servers stay closed until a subscription is active. Nothing on your server is deleted, and your files remain yours and reachable through your own Hetzner account.
Subscriptions are billed monthly in advance through Stripe. You receive an invoice for every payment that meets the requirements of § 14 UStG. Payment is due immediately on invoice.
If a payment fails, we keep access open while Stripe retries. If the retries do not succeed, the subscription ends and access closes.
7. Right of withdrawal for consumers
If you are a consumer within the meaning of § 13 BGB, you have the right to withdraw from this contract within fourteen days without giving any reason. The period begins on the day the contract is concluded.
To withdraw, tell us clearly by e-mail to m.hofmann@fastpal.com that you are withdrawing. Sending the message before the period ends is enough. We refund all payments received within fourteen days of your notice, using the same means of payment you used.
If you ask us to begin the service during the withdrawal period, you owe a proportionate amount for what was provided up to the point of withdrawal. Your right to withdraw lapses once the service has been provided in full, and only if you expressly agreed to that and acknowledged the consequence.
8. Term and termination
The subscription runs for one month at a time and renews unless cancelled. You can cancel at any time through the customer portal in your settings, with effect from the end of the current billing period. There is no minimum term and no notice period beyond that.
We may terminate with thirty days' notice to the end of a billing period. We may terminate immediately and close access if you use fastpal unlawfully, if you endanger the service or other customers, or if you are in arrears with payment despite a reminder.
When the contract ends, your access through fastpal.com ends. Your server keeps running in your Hetzner account until you switch it off or delete it there, and it keeps costing you money at Hetzner until you do. Your files stay on it and on any of your own computers you synchronised with it.
9. Availability
We aim to keep fastpal available but do not promise a particular uptime. Maintenance, faults at our suppliers, and problems on your own server or network can interrupt the service.
Your server is not ours. If it stops, is switched off, runs out of resources, or is suspended by Hetzner, fastpal cannot reach it, and that is not a defect of our service.
10. Your obligations
- Use fastpal only for lawful purposes and in line with Anthropic's usage policies and Hetzner's terms.
- Do not use it to attack, overload or gain unauthorised access to systems that are not yours.
- Keep your access credentials confidential and choose carefully whom you invite into your organisation.
- Make sure you are entitled to process the data you place on your server, including data about other people.
11. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent we have given a guarantee.
For slight negligence we are liable only where we breach an obligation whose fulfilment makes the proper performance of this contract possible in the first place and on which you may regularly rely. In that case our liability is limited to the damage that was foreseeable and typical for this kind of contract.
Any further liability is excluded. In particular we are not liable for loss of data or work caused by actions of the autonomous agent on your server, for costs you incur at Hetzner or Anthropic, or for the consequences of instructions the agent followed.
The limitations also apply in favour of our employees and the people we engage to perform our obligations.
12. Changes to these terms
We may change these terms where there is a valid reason, for example a change in the service, in the law, or in the suppliers we depend on. We will tell you by e-mail at least six weeks before the change takes effect. If you do not object before that date, the change is deemed accepted; we will point this out in the notice. If you object, either of us may terminate the contract to the date the change would have taken effect.
13. Governing law and place of jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in the EU, this does not deprive you of the protection of the mandatory law of your country of residence.
If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Coesfeld, Germany.
